I'm in the USA on an H1b visa related to the computing field, I was
wondering if anyone in my situation has been successful with
https://www.flightschoolcandidates.gov/ ? Their FAQ suggests that I
may not be eligible as I'm here to work not train, anyone been through
this before I spend the money to find out?

flight instruction? |

No, that has already been done, I've been living in the states for 5
years now, I have no worries about passing the check, the question
really is as I am here on an H1b temporary worker visa will learning
to fly violate this visa as technically I will be 'training' not
working...
I can't find this information on their website, no one is answering
the phone or returning calls at either AFSP or USCIS, I'm just trying
to avoid spending the $130 on the check if it will be denied for this
reason, if so I guess I'll have to continue soaring.

11. What happens if I take flight training without having the proper
visa?
Taking flight training without an appropriate visa is a violation of
your immigration status and could result in your arrest and removal
from the United States; therefore, it is important that you have a
visa that permits you to take flight training in the United States. If
you do not possess the correct visa, or if you have questions
pertaining to your visa status or the appropriate visas for flight
training, please contact The Bureau of Citizenship and Immigration
Services (http://www.uscis.gov), and the Bureau of Immigration and
Customs Enforcement (www.ice.gov) or the State Department Consular
Affairs Office for assistance. The AFSP will deny flight training
requests from Candidates who are present in the United States
illegally or who do not have an appropriate visa for flight training.
Fees paid for denied applications are not refundable. |

I think he may have problems. The TSA says you must have a Visa that
permits flight training. But an H1 only permits working.

the only person that can tell you is the people that issued the original
work VISA..
But learning to fly as a recreational endeavor should not be a factor.
I am not a VISA expert.

AFAIK, if you're on an H1b, you need to be working to maintain your
status. If, during your evenings and weekends, you want to persue
flight training, you may do so if you get past the homeland security
certification.
I did more or less the same thing, but before 9/11, so YMMV.

I happened to call AOPA this morning on an unrelated question, but I
asked them about this. The guy I spoke to didn't have an answer about
H1-B visas, but had 2 pointers. You can call the citizenship and
immigration office at 800-375-5283. You can also check the AOPA
homepage. On the right side of the page, there's a bar for quick links.
It includes a link, "Guide to TSA's Alien Flight Training Rule".
The only thing he said for sure was that, if the visa permits flight
training, you would have to train at a part 141 school. Green card
holders could train at part 61 or 141 schools.

That sounds wrong. I'm a TSA certified foreign flight training
provider and I've never been told I can't accept students on a visa.
In fact I did have one student on a work visa (under part 61) but he
was Canadian (the immigration rules for Canada are quiet different in
many ways).
I wonder if the answer depends on what stage of his residency the
applicant is in. Most employeers begin the long process of gaining
perm. residency for their employees because the H1 is very expensive
to maintain (about 1/2 the programmers I work with are on H1).

Thanks for everyones input, I finally received a reply from AFSP
(below) which states I cannot do it without going through the I-20
process which means I have to give up my H1 status, which I can't do,
love my job . I managed to speak to a human at USCIS, they also
stated this as fact.
Barney Rubble: I'd really appreciate it if you could put me in contact
with people that have done it, I seem to be hitting a brick wall..

Are you working on your green card (we always try to get our guys on
track for green cards as soon as possible because the H-1 is expensive
to renew)?? I'm sure once you have perm residency you can get approved
easily.
